The District Court in Seattle decided that Microsoft should pay for the use of Motorola patents in the console the Xbox, but the amount was incomparably smaller than the one expected by the plaintiff, alleging that the defendant unlawfully using its design.
According to Motorola, for the use of patents Microsoft had to pay a billion dollars for each year of infringement - a total of four billion. The judge determined the total payment of 1.8 million dollars.
We can imagine how disappointing was the decision of the judges for Google. Because the court evaluation will be a starting point in negotiations with other licensees, it is safe to say that the value of some patents Motorola declined.
A hearing on the second dispute between Microsoft and Motorola are scheduled for summer. As a result, it should be clear whether Motorola had violated its obligations under the licensing of patents, which are part of the standards under FRAND.
