The Japanese are considered a very polite nation. But Nikon has long suffered a violation of its patents by ASML and Carl Zeiss, until finally it sued them. This Japanese manufacturer of lithographic equipment for the release of semiconductors reported yesterday on its website.
The lawsuits against ASML and Carl Zeiss are filed with the courts of the Netherlands, Germany and Japan. Both companies are accused of violating 11 Nikon patents for lithographic technology and optical systems. Scanners are manufactured by ASML, and Carl Zeiss is the supplier of optical systems for the manufacturer. At the moment, ASML retains 83% of the chip scanner market and 93% of the scanner market for immersion lithography (with submerged plates in water).
In the 90s of the last century everything was the other way around. Nikon company in the market of scanners (then still - steppers) owned a share of about 60%. In 2001, Nikon initiated proceedings in the US court for violations of ASML and Carl Zeiss patents. In 2004, the parties agreed and entered into a cross-license agreement with a validity term until the end of 2009. From 2009 to 2014, an unsettled period was approved, during which the companies had to reach new agreements. That did not happen. Since then, ASML and Carl Zeiss have formally or informally violated Nikon's patents.
In January, ASML reported annual revenues of $ 7.37 billion for 2016. According to Nikon, about $ 3.8 billion of this amount is the money earned on the unauthorized use of its patents. The developer of original technologies has the right to expect compensation for the costs of research, the results of which someone uses without any compensation payments.
